Yanks face age discrimination suit

This little tidbit of news didn’t garner much attention on Friday afternoon, but the Yankees have been sued for age discrimination. A group of 13 waiters, aged 66 to 80, have claimed that the Yanks fired them when they closed the old Yankee Stadium and hired younger — and cheaper — workers instead. Supposedly, a Yankee official said to one of the waiters when firing them, “What could someone 73 years old offer the Yankees?” The waiters are asking for $3 million, and the team is, of course, denying the allegations.

People suing the Yanks over everything.

Rich companies will always be targets. That’s the way our civil judicial system appears to be set up these days.

Just like all the lawsuits against Apple for the iPods… I say just give them the money they want, if it will make them shut up afterwards.

The problem with just giving them the money is that there is always someone waiting behind them with a slightly more dubious claim (on down the line until you get someone suing the Yankees because they can’t beat playoff caliber pitchers). You can’t just pay them all, so you have to draw the line somewhere.

 
 

Rich companies are targets because some of them use shady tactics to maximize every penny of profits.

Certainly. But they’re also more solvent and can offer larger settlements. Anyway, these guys are suing for $230,000 each because they lost out on a chance to make $28,000. This is definitely a targeted suit. If there’s any merit to the claims, it will get settled. If not, the Yanks will try to get it dismissed. That’s my take at least.

i’ll play devil’s advocate here: what age is the cut-off point where it’s no longer “discrimination”?

i’d be surprised if age discrimination laws covered 80 year olds.

Legally, age discrimination applies to anyone over 45. Firing someone who’s 80 because they can’t do the job is acceptable, but simply firing them because they’re old (and likely paid more than a younger worker) is not.

but technically i don’t think they got “fired”.

once the stadium closed, their jobs went away.

the Yankees chose not to re-hire the same person for a similar, but different job, across the street.

i am guessing that while maybe a little callous and uncool, it’s not illegal.

there is a separate issue about the interviewer making that comment, and that person should be disciplined for being a jackass.

just adding that i am no lawyer, and don’t really feel all that strongly about this, but that i’m just shooting the sh*t b/c the yanks don’t play until 4 and the giants until 8….

I don’t know about you, but I liked it when they put a little Metamucil in my Beer. Very thoughtful of them.

My guess is that they were fired because the Yankees switched concession companies. Legends Hospitality (or whatever it’s called) did not have a duty to hire the workers from the former concession business.

 

My guess is Hal wanted to hire workers from Bagladesh for 50 cents a day, and Hank wanted to hire Hooters waitresses, so they compromised and just fired the old guys.
